This Privacy Policy describes how J Squared Solutions LLC, doing business as Opsify ("Opsify," "we," "us," or "our"), collects, uses, discloses, and protects information when you visit https://opsifyapp.com, create an account, or use our cloud software platform (the "Service").

By accessing or using the Service, you agree to this Privacy Policy. If you do not agree, do not use the Service.

This Privacy Policy should be read together with our Terms of Use (https://opsifyapp.com/terms) and End User License Agreement (https://opsifyapp.com/eula).

1. WHO THIS POLICY APPLIES TO

This policy applies to:

- Business users who register for and use Opsify ("Operators")

- Visitors to our website

- Individuals whose information Operators submit to the Service ("End Customer Data")

Operators are responsible for providing appropriate privacy notices to their own customers and for ensuring they have a lawful basis to submit End Customer Data to Opsify.

2. INFORMATION WE COLLECT

Information you provide

- Account information: name, email address, phone number, password, and organization details

- Business information: company name, address, branding, and settings

- User Content: customer records, jobs, quotes, invoices, notes, photos, communications, and other business data you upload or enter into the Service

- Payment information: subscription billing details processed by our payment processor (we do not store full payment card numbers on our servers)

- Communications: messages you send to us for support or feedback

- Marketing preferences: whether you opt in to product updates or our newsletter

Information collected automatically

- Usage data: pages viewed, features used, actions taken, timestamps, and referring URLs

- Device and browser data: IP address, browser type, operating system, and device identifiers

- Log and security data: authentication events, error logs, and activity needed to secure the Service

- Cookies and similar technologies: as described in Section 9

End Customer Data

Operators may submit personal information about their own customers, employees, and contacts. Opsify processes End Customer Data on behalf of Operators solely to provide the Service.

3. HOW WE USE INFORMATION

We use information to:

- Provide, operate, maintain, and improve the Service

- Create and manage accounts and organizations

- Process subscriptions and billing

- Authenticate users and prevent fraud or abuse

- Provide customer support

- Send service-related communications (for example, account notices and security alerts)

- Send marketing communications if you opt in (you may unsubscribe at any time)

- Enable optional AI-assisted features you choose to use

- Comply with legal obligations and enforce our agreements

- Analyze usage trends to improve performance and reliability

4. HOW WE SHARE INFORMATION

We do not sell your personal information. We may share information with:

Service providers and subprocessors that help us operate the Service, such as:

- Cloud hosting and database providers

- Payment processors (including Stripe)

- Email and newsletter providers

- Analytics, monitoring, and security vendors

- AI or machine learning service providers, when you use AI-assisted features

- To protect the rights, property, or safety of Opsify, our users, or others

Operators' End Customer Data is shared only as needed to provide the Service to the Operator or as required by law.

5. SMS/TEXT MESSAGE COMMUNICATIONS

If you opt in to receive text messages — for example, when a business using Opsify collects your consent through a service request form on its website, verbally when you contact the business to request service, or when you accept an estimate online — Opsify will send you text messages on behalf of that business, delivered via SMS or, for international phone numbers, via WhatsApp. These messages are service-related and may include estimate and quote notifications, invoice and payment notifications, appointment reminders, parts and order updates, and job status updates.

- Message frequency varies based on your service activity.

- Message and data rates may apply.

- You may opt out at any time by replying STOP to any message. You may reply HELP for assistance or contact us at hello@opsifyapp.com.

- Consent to receive text messages is not a condition of purchasing any goods or services.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile telephone numbers and text messaging opt-in data and consent are not shared with, sold to, or transferred to any third parties, except for vendors and service providers acting on our behalf solely to deliver the messages described above.

6. PAYMENT PROCESSING

Subscription payments are processed by third-party payment processors such as Stripe. Payment information is handled according to the processor's privacy policy and security practices. Opsify receives limited billing metadata (such as customer ID, subscription status, and transaction records) needed to manage your account.

If you connect a payment processor to collect payments from your customers, that connection is governed by the third party's terms and privacy policy.

7. DATA ROLES

For End Customer Data submitted by Operators, Opsify generally acts as a data processor/service provider and processes that data on the Operator's behalf according to the Operator's instructions and our agreements. Operators act as the data controller for End Customer Data and are responsible for their own compliance with applicable privacy laws.

8. DATA RETENTION

We retain information for as long as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. When you close your account, you may request a data export within the period described in our Terms of Use. After that period, we may delete your data in accordance with our retention practices.

9. COOKIES AND TRACKING

We use cookies and similar technologies to keep you signed in, remember preferences, secure the Service, and understand how the Service is used. You can control cookies through your browser settings, but disabling cookies may affect certain features.

10. SECURITY

We use administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, or alteration. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. YOUR CHOICES AND RIGHTS

Depending on where you live, you may have rights to:

- Withdraw consent where processing is based on consent

To make a request, contact us at hello@opsifyapp.com. We may need to verify your identity. If you are an end customer of an Opsify Operator, please contact that business directly for requests relating to data they control.

You may opt out of marketing emails by using the unsubscribe link in a message or contacting us.

12. CHILDREN'S PRIVACY

The Service is not directed to children under 18, and we do not knowingly collect personal information from children under 18. If you believe we have collected such information, contact us and we will take appropriate steps to delete it.

13. U.S. RESIDENTS

Opsify is based in the United States and processes information in the United States. If you access the Service from outside the United States, you understand that your information may be transferred to, stored in, and processed in the United States and other countries where our service providers operate.

14. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. We will post the updated policy on the Site and update the "Last Updated" date. Material changes may also be communicated by email or in-app notice. Continued use of the Service after an update constitutes acceptance of the revised policy, subject to applicable law.
